Charter 20.02(d) timeline

• Feb. 14, 2008 — Board of Ethics discusses whether Charter Review Commissioner Jonathan Chun should relinquish his seat because he represents private interests before county agencies in violation of Kaua‘i County Charter Section 20.02(d).
• March 13, 2008 — Board of Ethics clears Chun, allowing him to continue to serve as chair of the Charter Review Commission, on the strength of a County Attorney opinion, which it declines to release to the public.
•May 11, 2009 — New Board of Ethics member Rolf Bieber files complaints against fellow board members Mark Hubbard and Judy Lenthall as well as Cost Control Commissioner Lorna Nishimitsu after personally witnessing apparent violations of 20.02(d).
• May 14, 2009 — Board of Ethics releases the County Attorney opinion behind the Chun decision. The opinion, which says the Charter must be “read in conjunction” with the County Code, is described as “fatally flawed” by board member Paul Weil. New County Attorney Al Castillo tells the board he agrees the two documents should be read in conjunction.
•June 4, 2009 — Board of Ethics clears Hubbard, Lenthall and Nishimitsu, pending receipt of a written opinion from Castillo. With Bieber, Hubbard and Lenthall excluded from voting, the board’s remaining four members unanimously vote that there were no violations of the Charter.
•July 9, 2009 — Board of Ethics rejects written opinion from new Deputy County Attorney Mauna Kea Trask. Weil says he made a mistake in voting to clear Nishimitsu in June. Rules changed to allow public discussion of disclosure statements.
• Aug. 13, 2009 — Board of Ethics regular meeting scheduled for 9 a.m. Updated opinion expected from Trask.
