Council to air open government concerns

LIHU‘E — Two weeks after their attempt to change County Council rules fell flat, Council members Tim Bynum and Lani Kawahara on Tuesday made significant headway in their drive to address issues of open government on Kaua‘i.
In a move similar to their unsuccessful challenge to Council Chair Kaipo Asing’s power on June 3, Kawahara and Bynum sought to amend the agenda at the meeting’s outset. This time around, however, the pair proposed a communication requesting agenda time at a future meeting, sidestepping the Sunshine Law problem that plagued them last time out.
County Attorney Al Castillo said the new communication itself is not of “reasonably major importance” and therefore the Sunshine Law does not apply. When pressed by Asing and Councilman Daryl Kaneshiro for further explanation, Castillo instructed them to look only at the communication and “not the substance of what the proponents want to do in July.”
In the communication, Kawahara and Bynum requested agenda time at the July 8 council meeting to discuss four matters: 1) Council members’ access to the agenda; 2) The placement of public documents, including meeting minutes, on the county’s Web site; 3) Equitable and timely circulation of council service documents; and 4) General access to information by the public and council members.
The two wrote that the request reflects the wording of an online citizen petition, which can be found at www.ipetitions.com/petition/opengovernmentkauai and contained nearly 300 virtual signatures as of press time. The duo has been sending e-mails touting the petition and their Web site, kauaiinfo.org.
Asing protested the proposed communication, at one point asking incredulously “Why would we want to discuss in-house rules (in front of) the public?” Just minutes after the meeting began and before the matter had been decided, the chair called for a recess that lasted for nearly an hour.
When council members reconvened, Kaneshiro made a rare motion amending the communication, giving Asing the flexibility and discretion to create agenda time at either the July 8 or July 22 meeting. The amended motion passed unanimously.
“I’ve waited two and a half years, I can wait another month,” Bynum said later.
The fact that the communication was never technically acted on after it was added to the agenda Tuesday could be irrelevant; even received or approved communications are non-binding. The issue forcing Asing’s hand as he builds July’s council agendas will likely not be an issue of legality but the pressure caused by unanimous council support for the communication as well as public outcry.
In a preview of the discussion now due to be heard publicly next month, Bynum on multiple occasions pilloried County Clerk Peter Nakamura for failing to distribute in a timely manner communications addressed to all council members.

No executive session was convened on the matter. How Nakamura’s performance and other government transparency issues are addressed in July remains to be seen.

" Elected officials do not fall under "Personnel". They serve at the pleasure of the electorate. In other words the People are their boss. Discussion pertaining to them is not covered by the Executive Session Privilege. As far as no one questioning rules, it could be that no one dared to before. The more the Chairman balks the greater the skepticism . Issues between elected officials can be discussed one to one. When a quorum is present the discussion is only allowed in open session. Some may not like what is said, but closed doors are not an option. "

Mr. Asing (who has served us incredibly well for much of his life dedicated to Kauai and its people, and deserves an award...but he and the new same ilk as him are trying their best to hold on, just hold on...nothing wrong w/ that if you are one of them living w/ horse blinders.
But just holding on when the world is flying by? That's conduct not befitting our elected. When the elected majority stymie the ideas of the minority elected...this majority is telling us clearly...we do not represent the majority...we do not represent you...Wenokeah...we do what we want...got more tax $?
About 4,500 acres of Kealia Mauka and Makai were bought not too many years ago for $7 million. Now 2 makai acres of that are about $2 million if any of them are left. Houses cost 2 million now, not 4,500 acres. There are bigger big-invaders waiting to come ashore on Kauai...if we let them. Kauai is no longer a Pacific Ocean dot...it is a world wide attraction. It could be a World Heritage Park...the whole place, yeah your house and mine and all.
And as any well managed park...you gotta limit the traffic so not to damage the park...keep it simple. You just can't show up, you gotta make an appointment like we all do when we go about business in business offices, Kauai is a tourism business, what's the difference. When we survive this rip-off current economy, it will be proof that we don't need all the visitors...they need us times are good, though we need to treat the visitor not with arrogance or rudeness, but still yet w/ Love and Aloha.
Nothing wrong w/ "hard to get" w/ all categories of island life and visitor items of eat, sleep, and recreate. With less visitor slots available, what is available will be higher valued translating into better incomes for Kauai's people at all levels...and why not, don't we deserve it so. Why move away from family and friends when you could earn that same or better money here. Say who is managing this place anyway...this should have happened already some time ago.
More development means the SUPPLY AND DEMAND ratio turns loser for Kauai people. High amount of supply means lower demand and to compete you must lower your prices, your overhead, your employees get lower wages and the vendors/providers of services get less orders...less money. Hit and run developers and those feeding off them make the money and live well serving more big developers and big business instead of small business.
And all you block voters in the state and county worker click...what did all that follow the leader get you...cut in working days, cut in income...now it is do it or die...and still maybe lose your home. What did all that allegiance get you? Look like nada now. Better check your loyalty next election...blind loyalty got you here...it may get worse.
So far you cannot stop change. The current crop of council in discussion here are no longer capable it appears to be able to assess little old (hey, 5 million years) Kauai in its position in the global tourism arena we are in. While Mr. Furfaro has visitor savvy still perhaps w/ his lock step old Kauai attitude he is same like the 6 others...Tim and Lani included. Who of you really know what's going on about Kauai in its relationship and competitiveness in the world visitor industry...whether in a global boom or this global demise.
Perhaps to move Kauai into its rightful world position, we need people w/ extraordinary knowledge, expertise, and experience in global travel and tourism to navigate Kauai w/out sinking our ship...like Maui has...and like Maui we seem sadly headed down in quality as well...Maui has already dropped their slogan...No Ka Oi. How embarassing ! ! !
Perhaps a 2 or 4 year KCC program (yeah yeah I know it is a 2 year school...but if that is your attitude you are the log in the road, dinosaur...just add 2 years of courses...free guest speakers living or visiting here, on-line classes from around the world...all this at KCC developing knowledge in world tourism for our young adults and next keikis...all this can be in order, to make the change conducive to a better quality of life on Kauai. How many of our natural resources, our children, have left Kauai already, families saddened, generations broken. Let's invest in ourselves, our families and friends. I can see the future...can you. We have the means and ability to create it. We need leaders who can. Who are the leaders of the future, well you know, it is the youth...but don't bring them to the door of leadership w/ no knowledge or expertise. Train them now. Elect them now...there is a plan for that as well.
The youth of Kauai are past so much old school stuff already. The days of the Democratic (machine) and Republican (rebels) are over. If the youth start their own movement, they already have enough votes to sweep all our elections. At least the youth couldn't possibly mess things up any worse than is already being done w/ the older generation...to put it mildly. At least the youth would learn by their mistakes, instead of saying "so what" and digging the ruts deeper...this where the managers of the popular elected official comes into effect.
As well, our taxes would be better spent , before and after KCC tourism graduation, sending these college young adults to the world's best visitor destinations learning about the best tourism ideas, methods and functions for the world's: islands, countries, cities, river, lake, mountain, ocean resorts, nature get-aways, restaurants, activities, night life entertainment, parades, multi during the year festivities like the wonderful Coconut Festival in Kapa'a..yes the tax money better spent on their travel than sending our beloved Bernard and his pal(s) to Japan...like the others again and again always going to Japan ad nauseum...and who ever sees free lance Japanese visitors here...nor much anymore of the Japanese bus loads coming for the day to Kauai and leaving in the evening w/out leaving much kala for the Kauians.
Europeans are mounting a visitor invasion...and they all speak English, saving us time to be bi-lingual to so many languages. We need to be ready for them, are we, as they are here already
Kauai does not need to be desperate about the economy and tourism...KAUAI is the Mother Lode of all Visitor destinations...if we don't break it w/ over development, outsiders calling the shots, painting their own outside pictures on our unique island landscape here at the top of the chain..
Development? Who among we and you elected can say "NO"...moritorium our Kauai now as to big development...NOW...not Mahn Yah Nah, baby.
While you old and new fogies are hiding behind closed doors in the sunshine-less incandescent dark moon light...the world is passing you and therefore Kauai by. You gotta go outside get on airplanes and see what the rest of the world is doing...ooops to late, you are too old already, and looking for retirement money. But our youth is ready to do it all. Let's help them to help us. Unleash their potentials to lift Kauai to the top...send them abroad for a lifetime experience to spend their lifetimes helping Kauai reach its optimum for the best for all of us.
Those discontent w/ the current situation...you need to heed this, you need now to groom new potential elected leaders or at least popular vote getters wise enough to act after being elected to turn over their new authority to those not popular or known enough to be elected but capable to make Kauai mo bettah, to harness the potential of this island put it to its what's best for Kauai use for the old and young people and families of Kauai.
We need a popular mayor, nothing wrong with that, like Bernard, who else is gonna maha the baby luaus, gatherings, etc., of the people; the new mayors coming down the line must be mandated to hire a highly educated, knowledgeable, and experienced island manager...the very same system for all council members...instead of the often ignorant elected sitting at the tables of important island discussions, the island manager, and the council managers might serve us all better should these managers be in the front of the discussion allowing the elected to counsel the managers instead of the other way around.
Council committees each should have their own manager w/ education, knowledge, and experience/expertise in the field of that council committee...Public Works, Waste management, etc. We would have to continue to be morons to allow elected friends to be heads of committees that they have no or very little education, knowledge or experience in besides sitting at meetings talking about it. Maybe this way the eastside would not have so many 3rd (er, a 4th) world stink locations in the midst of our absolute awesome World Destination Park...Kauai. Stink holes are an extreme embarrassment to our way of life. You do realize you are smelling human feces...if you can smell it, it is going into your blood stream...yep the stink goes from your nose and mouth to your lungs and whamo right into your blood stream boys and girls.
Another thing, if true, our elected people after 2 terms get lifetime pensions at their highest gov't payroll and at a high % of that. End that. You were elected to serve, not retire on our backs after a stint of little success. Retro cancel those retirements for the fewly elected or at least downscale the free retirements to at least the level of their regular job retirement or social security, but just one of the above not all 3. I don't think the now and current hard working youth and the current tax payers want to watch triple retirement checks and perks and benefits go to a few who may have helped themselves when so many families on Kauai no more even any health insurance.
And w/ managers working higher up than the elected officials and thus doing more work than the elected; then Mr. and Ms elected you came on board to serve so w/ others more suited to do your work it only makes sense to reduce your pay and pay the people who will save will save us money and put all of us into a mode of higher prosperity.
The alternative is to groom new elected officials. People young or old willing to sign contracts before the election w/ the people...to do what the people want. And if they do not do what the people want they agree to resign w/ out argument. Do it, do it right, or Adios.
Senior year class and Kauai Community College officers island wide should be evaluated for their leadership and electability skills, same for Kauai's top athletes and business people need to be culled out and evaluated for election potential...not this same olds boring clan. Term limits are in order. Kaipo has done us so well but he seems to have outmoded his wonderful self holding onto the old ideals that were new and good for us then when he was fresh on the boat of politics here. Some of the others are already ready to go.
Don't get hung up in racial or employment block voting. Vote the best or you may be voting yourself and family into a rut where the sun will never shine...and your job may turn to that as well. Protect yourself, vote with your brain...but main thing...at least VOTE.

If they are just "in-house rules" then they do not affect a large number of the population, so they should be able to be put on the agenda without notice. But, even though these are "in-house rules" of simple Council procedure, it should not be in Executive Session, as it is the public's right to see and hear these discussions. There should be nothing wrong with discussing Council "in-house" procedure where the public should be able to see and hear it. The Council's business IS the public's business! What else would it be, a fiefdom? "

But, even though these are "in-house rules" of simple Council procedure, it should not be in Executive Session, as it is the public's right to see and hear these discussions. There should be nothing wrong with discussing Council "in-house" procedure where the public should be able to see and hear it. The Council's business IS the public's business! What else would it be, a fiefdom? "

Mr. Castillo....Mr. Nakamura....you fellas need to wake up, eh! Who do you serve? Who is your Master? Since the tax payers of the Island pay your wages....and not 'other' interests, you can be held accountable.
Folks here on the south and westside that I talk story with are sick and tired of the way the Council, Planning Comission, and Mayor's office has been conducting 'business' for years.
Ok, so I'm just one little voter, yeah.....but there are many that share my sentiment. "I will make my voice heard!" I will be seen on the roadways and in print and on the air here at home 'and' I'll take the battle to Honolulu and expose all for what you are and have become.
I am fed up with the way you folks are conducting 'business'and I'm not the only one. "
